Terms of Service
1. The service
LookyMaster provides browser-based audio analysis, mastering, and comparative sound-analysis tools ("the Service"). Audio processing runs on your own device; your audio files are not transmitted to or stored on our servers. The Service is offered under paid subscription plans only.
2. Your account
You must provide accurate registration information, be at least 18 years old, and keep your password confidential. You are responsible for activity under your account. One account is for one person; do not share credentials. We may suspend or terminate accounts that violate these Terms.
3. Subscriptions and billing
Plans are billed monthly in advance through Stripe, our payment processor. You may cancel at any time via the billing portal; cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable. Prices may change with notice; changes apply from your next billing period. "Founding" pricing remains in effect while your subscription remains continuously active.
4. Acceptable use
- Process only audio you own or are licensed to use. You retain all rights to your audio; we claim none.
- Do not attempt to breach, probe, or overload the Service, other users' accounts, or our infrastructure.
- Do not copy, scrape, reverse-engineer, resell, or redistribute the Service's software or reports except as permitted by law.
- Do not use the Service for unlawful purposes.
5. Research tier — important limits
The Scientific Research tier produces diagnostic and comparative reports for research and monitoring use only. Reports are not a substitute for professional inspection, certification, or judgment. Do not rely on them as the sole basis for decisions involving safety, airworthiness, mechanical fitness, animal health, or human health. We make no representation that any output is suitable for regulatory or safety-critical purposes.
6. Not medical advice
The Service applies published hearing research to audio-processing decisions. It is not a medical device, does not provide medical advice, and makes no claim to protect, diagnose, or treat hearing or any health condition.
7. Intellectual property
The Service, including its methods, software, displays, and reports, is protected by intellectual-property law, including U.S. patent pending No. 64/132,904 and the LookyMaster™ mark. Your subscription grants a personal, non-transferable license to use the Service; it transfers no ownership.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that any output will meet your requirements.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid us in the three months before the claim arose, and we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill.
10. Termination
You may close your account at any time. We may suspend or terminate the Service or your account for breach of these Terms, with notice where practicable. Sections 5–9 survive termination.
11. Changes and governing law
We may update these Terms; material changes will be posted on this page with a new effective date, and continued use constitutes acceptance. These Terms are governed by the laws of the State of Texas, U.S.A., and disputes shall be resolved in the state or federal courts of Texas.
